1. Agreement & Acceptance
By accessing or utilizing Khayal platforms, AI agents, or automation workflows, you explicitly agree to be bound by these Terms and our Privacy Policy:
- If utilizing services on behalf of a corporate entity, you represent and warrant that you possess full authority to bind that entity.
- Khayal reserves the right to modify these terms periodically; material updates will be communicated through official channels and documented on this page.
2. Intellectual Property Rights
All digital assets, source code, architectural schematics, designs, and trademarks displayed on our platforms or provided in prototypes remain the exclusive property of Khayal:
- Unauthorized reproduction, redistribution, reverse engineering, or extraction of codebases without prior contractual authorization is strictly prohibited.
- Enterprise intellectual property assignments for bespoke software are governed independently by formally executed master services agreements (MSAs).
3. WhatsApp Solutions & API Usage
Deployment of WhatsApp AI bots and automated messaging requires full compliance with acceptable use policies and third-party terms (e.g., Meta):
- Clients must adhere to applicable regional telecommunications regulations, anti-spam policies, and recipient privacy mandates.
- The client bears sole responsibility for registered numbers and the legitimacy of dispatched messaging content.
- Khayal is not liable for line restrictions or bans enacted by Meta resulting from policy infringements by the account holder.
4. Billing, Subscriptions & Cloud Hosting
Fees and cloud subscriptions recur according to the selected service tier and signed contract terms:
- Cloud infrastructure and AI bot hosting operate on prepaid monthly or annual billing cycles to guarantee uptime.
- Fees incurred after operational deployment and system integration are non-refundable unless explicitly stated otherwise in the agreement.
- Unpaid accounts following formal reminders may experience automated service suspensions to avoid unauthorized infrastructure consumption.
5. Limitation of Liability & Technical Warranty
We strive for 99.9% platform availability and robust engineering execution, subject to the following conditions:
- Khayal is not liable for disruptions arising from third-party vendor outages, including AI model providers, payment gateways, Meta APIs, or telecom networks.
- Technical support and warranties cover direct Khayal application code and scheduled maintenance agreements.
6. Modifications & Termination
Either party may modify service scopes or initiate termination subject to standard commercial and legal notice terms:
- Khayal reserves the right to terminate service access immediately if the platform is deployed in violation of applicable laws or regulatory standards.
- Cancellation requests for active recurring subscriptions must be formally submitted and require settlement of all outstanding balances.
